Terms & Conditions

1. A stay for a period of every year for up to 6 Nights and 7 Days at Onyxx Travels properties each year within India for the stipulated number of years from the date of this Agreement.
2. The 6 nights & 7 day holidays can also be taken in any of the tied up properties worldwide.
3. The accommodation shall be provided in regular and superior rooms for Studio Members and 2 such rooms will be given to members who have bought One Bedroom Membership.
4. All short-term accommodation stays include Studio rooms only for the selected time for the Second Party, Spouse and 2 children below 8 years of age. Extra beds would be charged at Rs. 1000/- in Onyxx Travels owned properties and as applicable in associated properties. Dependent vacationers above 18 are considered adults. Maximum 3 adults can be accommodated in one studio room. An extra room will need to be taken at an additional cost if there are more than 3 adults. 1BR is for 4 adults and two children under 8 years.
5. SHORT TERM ACCOMMODATION VACATION – Floating Week Opted.
6. The vacationer is also required to pay Annual Maintenance Charges (AMC) of Rs. 12,000/- for a Studio unit and Rs. 22,000/- for a 1 BR unit for vacations in the First Party's owned or affiliated/associated properties. AMC applies from the date of this agreement and may be revised without prior notice. AMC is payable online, excluding taxes, irrespective of usage of vacations, facilities or amenities. Failure to clear dues, including AMC, constitutes a default, and vacations cannot be used until all dues are cleared. No waiver of AMC is offered. An exchange fee may also apply for domestic or international associated locations. AMC will be generated nine (9) months from the date of this agreement and is payable within twelve (12) months from the agreement date, irrespective of whether full or part payment has been made towards the product price.
7. If the Second Party chooses the ‘Cash Out’ price, the entire amount must be paid within 30 days of the initial payment. If payment is not completed within 30 days, the First Party may revoke the ‘Cash Out’ price benefits and collect the full product price.
8. This is a limited and exclusive offer. If the full fee is not paid within 45 days from the initial payment, the amount paid up to that point may be forfeited by Onyxx Travels and any allotted vacations cancelled.
9. If the Second Party continues to default on payments towards the ‘Cash Out’ price even after the year, the First Party reserves the right to downgrade the product benefits to the closest-priced product to complete the transaction. Once downgraded, benefits under this agreement can no longer be availed. Benefits already used before downgrading will be set off against the benefits of the downgraded product.

Particulars of the Vacations

10. Onyxx Travels has the right to withdraw any properties from the list at any time without prior intimation. Holiday bookings are processed online/offline on a first-come, first-served basis during the specified booking period. Online bookings are confirmed subject to room availability.
11. The card will be issued to the Second Party subject to submission of ID proof, address proof, photographs and compliance with KYC norms for the whole family.
12. Holiday bookings must be made online using the username and password mentioned on the online receipt, which will also be sent with the welcome letter and booking instructions. The Second Party may use vacations after full payment of the product and other dues, even before receiving the card and welcome kit.
13. During peak periods with high occupancy, shorter holiday durations may be provided to accommodate other members after giving priority to higher-season members.
14. A continuous vacation of 6 nights and 7 days may be split into any one of the following options per year:
    • 2 Nights and 3 Days
    • 3 Nights and 4 Days
    • 4 Nights / 5 Days and 2 Nights / 3 Days
15. Exit Option: This agreement may be cancelled by either party, without stating a personal reason, by giving written notice within 7 days from the date of the signed agreement. If no notice is received within this period, the parties agree to be bound by the signed agreement, and the Developer shall not be entitled to refund any money held by it.
16. Refund: If the agreement is cancelled by the applicant(s) under Clause 15, the company shall refund the payments held after deducting an administration fee of Rs. 25,000/-, without interest, within 90 days from the cancellation request.
17. All holidays are subject to availability under the floating-week system. Booking opportunities are provided according to season/points and the stipulated booking dates. Members in higher categories receive booking priority before members in middle or lower categories.
18. Vacation rentals are permitted only during off-peak seasons through personal contacts and may not be advertised. Onyxx Travels does not engage in renting vacations and reserves the right to reject any booking.
19. Vacation vouchers will be issued to the primary applicant at the address in this agreement only after all required documents have been submitted and satisfactorily verified by Onyxx Travels Vacation Club. No separate holiday vouchers are available for sale. Benefits are limited to those set out in this agreement.
20. The Second Party must pay taxes and other levies imposed by the government.
21. Charges for consumables such as food, beverages and other facilities used by the Second Party and guests will be determined by management and must be settled daily. No credit facilities will be extended.
22. The Second Party may be denied use of vacations under this agreement if any amount remains outstanding under another agreement payable to the First Party.

Covenant of Purchaser

23. The Second Party agrees to purchase vacations from Onyxx Travels, and Onyxx Travels accepts the purchase subject to the terms and conditions of this agreement.
24. The Second Party confirms understanding of the benefits available under the vacation schemes listed in this agreement. No benefits other than those listed will be available.
25. The Second Party must inform the Customer Care Department of any changes to their address or telephone numbers to keep records updated. The Second Party permits Onyxx Travels to contact them by phone, SMS or email regarding services, schemes or future offers, including where the party is registered under the TRAI-regulated DND service.
26. The Second Party is bound by the rules and regulations of Onyxx Travels, as amended from time to time. Management's decision shall be final in all matters.
27. All applicable statutes shall be binding on the Second Party. If any legislative amendment or enactment imposes additional obligations on the First Party or changes the nature of its activities to its detriment, the affected provisions of this agreement shall be treated as extinguished to the extent described in the original clause, and the Company shall not be responsible for the consequences of such changes.
28. The Second Party understands that this agreement in printed form only supersedes any written or oral communications, variations or handwritten remarks made by agents, representatives or the Second Party, including communications on company letterhead or stamp paper. The benefits and terms stated in this agreement are final and binding on both parties.
29. The Second Party confirms that no verbal or written promises or assurances deviating from this agreement have been made by Oynxx Travels personnel.
30. The Second Party declares that the particulars provided are true, correct and complete. Onyxx Travels shall not be held responsible for losses, damages or inconvenience caused by incomplete or incorrect information. Any change of residence must be reported to Onyxx Travels within 30 days, along with address proof. If a change of address is not reported, communications sent to the address stated in this agreement, including communications through lawyers, shall be deemed served.
31. The Second Party acknowledges and confirms that all terms and conditions of Onyxx Travels are binding upon signing this agreement and that future amendments shall also be binding.
32. The Second Party acknowledges that they have been treated pleasantly and courteously and have entered into this agreement freely, without compulsion, coercion or undue influence by Onyxx Travels or its agents/representatives.
33. The Second Party confirms having read, understood and accepted the above terms and conditions, benefits and obligations.
